These Terms govern your use of buildsystems.dev and your interactions with Build Systems. By using the website, you agree to these Terms. A separate proposal, statement of work, order, or service agreement may apply when you purchase services.
1. Build Systems services
Build Systems offers business systems coaching, hands-on systems support, custom software and system design, integrations, and fractional technology and systems leadership. Website descriptions, availability, prices, and ranges are informational until confirmed in writing.
The written agreement for an engagement controls its specific scope, deliverables, schedule, access, responsibilities, fees, cancellation terms, intellectual-property terms, confidentiality terms, and support obligations. If that agreement conflicts with these Terms, the engagement agreement controls for that work.
2. Coaching and implementation boundaries
Coaching and advisory services provide strategy, feedback, review, prioritization, and accountability. Unless a written agreement says otherwise, you and your team remain responsible for decisions, implementation, legal compliance, business operations, data, backups, and results.
Software development, system builds, embedded operating work, and fractional leadership are separately scoped services. Work outside an agreed scope may require a new proposal, change order, fee, or schedule.
3. Pricing, payment, and the coaching guarantee
Payment timing, recurring charges, expenses, cancellation, and other commercial terms are stated in the applicable checkout, invoice, proposal, or service agreement.
The website's 30-day money-back guarantee applies only to the first $500 coaching payment. To qualify, the client must complete the readiness assessment and attend the first coaching call. If Build Systems is not helping the client identify and move the right work forward, the client may request a refund of that first $500 payment within 30 days.
The coaching guarantee does not apply to custom projects, software delivery, fractional leadership, third-party fees, expenses, or other separately scoped work. Other fees are refundable only when the applicable written terms say so.
4. Client responsibilities
You agree to:
- provide accurate and timely information, access, decisions, and feedback
- designate people authorized to approve priorities, scope, and deliverables
- have the right to share all data, materials, content, systems, and credentials you provide
- maintain appropriate backups and internal controls for your business and systems
- review recommendations and deliverables before relying on or deploying them
- use the website, services, and deliverables lawfully
5. No guarantee of business results
Build Systems will perform agreed services in good faith, but does not guarantee revenue, profit, cost savings, growth, adoption, availability, security, regulatory approval, or any other business outcome. Results depend on client decisions, execution, team participation, market conditions, third-party platforms, and factors outside Build Systems' control.
6. No regulated professional advice
Build Systems does not provide legal, tax, accounting, investment, medical, or other regulated professional advice. Business and technology guidance should be reviewed with qualified professionals when those matters are involved.
7. Third-party services
Recommendations and deliverables may rely on third-party software, platforms, APIs, vendors, hosting, or other services. Their availability, pricing, security, functionality, and terms are controlled by those providers and may change. You are responsible for reviewing and accepting applicable third-party terms and fees.
8. Intellectual property and confidentiality
Build Systems owns the website, brand, methods, templates, pre-existing materials, and general know-how. Ownership and licenses for client-specific deliverables are defined in the applicable written engagement agreement. No ownership transfer occurs unless the written terms and required payment conditions are satisfied.
Confidentiality obligations for client work are governed by the applicable service agreement or nondisclosure agreement. Do not submit confidential credentials or highly sensitive information through the public contact form.
9. Acceptable website use
You may not:
- submit false, fraudulent, unlawful, or infringing material
- attempt unauthorized access to the website, systems, accounts, or data
- interfere with website operation or security
- use automated tools to abuse, overload, or probe the website
10. Website availability and disclaimers
The website is provided on an "as available" basis. To the extent permitted by law, Build Systems disclaims implied warranties relating to the website, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted, error-free, or completely secure operation.
11. Limitation of liability
To the maximum extent permitted by law, Build Systems will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services, including lost profits, lost revenue, lost opportunities, or lost data. Liability terms for paid services are governed by the applicable written engagement agreement.
12. Suspension and termination
We may restrict website access or decline an inquiry when reasonably necessary to protect the website, Build Systems, clients, or others. Termination and post-termination obligations for paid services are governed by the applicable written agreement.
13. Changes, severability, and governing terms
We may update these Terms by posting a revised version with a new date. If any provision is found unenforceable, the remaining provisions continue to apply. Any governing-law or dispute-resolution provision in an applicable service agreement controls disputes relating to that engagement.
